Terms of Use

These Terms of Use ("Terms") govern your use of the free services, software and websites (the "Service") provided by Matthews Paint, a PPG Industries company ("Matthews Paint"). By using the Service you agree to be bound by these Terms. If you're using our Service on behalf of an organization or entity ("Organization"), then you are agreeing to these Terms on behalf of that Organization, and you represent and warrant that you have the authority to bind the Organization to these Terms. In that case, "you" and "your" refers to that Organization, as well as you—the User.

Privacy

Matthews Paint collects your contact information, including name and email address, when you register for use of the Service. Additional information may be required, as indicated during the registration process. Collectively, this is your "Profile" for use of the Service.

We may use your email address to send you Service-related notices. These notices are separate from the marketing email communications from Matthews Paint, although you may opt into the marketing messages via this Service.

Your Profile information is stored on a server or servers located in the United States. Your use of the Service constitutes consent to have your name, email address and other registration information stored in the United States, regardless of where you use the service. You have the right to withdraw your consent at any time by sending a request for removal to privacy@matthewspaint.info (from your registered email address).

Please allow up to ten business days for an emailed request for removal to be received and processed. When processed, your profile record is deleted from the server and is unrecoverable. (Server and data backups are deemed a reasonable exception to the immediate and complete removal, and are retained for approximately four weeks before they, too, are deleted.)

Besides your Profile information, we also automatically record activity with your public IP address, as is typical for website logging. Log files help us monitor, analyze, improve and maintain the Service. We also track activity with the help of Google Analytics, to review usage trends. Please note: Data collected in server logs and aggregated in Google Analytics will not be removed as part of a Profile removal request, described above.

We use "cookie" technology in provision of this Service. Cookies may be blocked in your browser but doing so will restrict your access to portions of the Service which require registration.

We share your Profile and usage information related to this Service with our marketing and technology service providers. These third parties have access to your Profile and usage information for the sole purpose of supporting you as a user and Matthews Paint as the provider of the Service.

Your Obligations

You must provide accurate information when you register to use the Service.
You are responsible for safeguarding your password and for all activities that occur under your account.
You must comply with these Terms at all times when using the Service.
You may never use another user's account without permission.
You may not attempt to undermine the security or integrity of the computing systems or networks used in provision of this service.
You may not use—or misuse— the Service in any way that may compromise the functionality of the Service.
You may not attempt to gain unauthorized access to any resources other than those to which you have been granted. This includes features of the Service and the computer system on which the Service is hosted.
You may not disassemble, decompile or reverse engineer the Service or attempt or assist anyone else to do so.
Our Service is not intended for use by persons under the age of 13. By using the Service you are representing to us that you are over the age of 13.

Termination

You are free to stop using our Service at any time. We also reserve the right to suspend or end the Service at any time, at our discretion and without notice. We may also terminate or suspend your access to the Service at any time if you are not complying with these Terms, or if you are using the Service in a manner that we believe may cause us financial or legal liability.

Intellectual Property Rights

The Service constitutes Matthews Paint's intellectual property and will remain the exclusive property of Matthews Paint and its licensors. Use that may infringe upon or otherwise compromise Matthews Paint's intellectual property is grounds for termination, at our sole discretion.

Modifications to the Service

The Service may be modified from time to time, often without prior notice to you. Your continued use of the Service constitutes your acceptance of such modifications. If you are not satisfied with a modification we make to the Service, your sole remedy is to terminate your use of the Service.

Indemnification

You agree to defend, indemnify and hold harmless Matthews Paint and its agencies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service.

No Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT, ENDORSE, GUARANTEE OR ASSUME RESPONSIBILITY FOR ANY THIRD PARTY APPLICATION OR SERVICE THAT PROVIDES ACCESS TO OUR SERVICE (E.G., A LINK TO THE SERVICE).
